Whoever without authority makes, uses, sells, offers to sell or imports a patented invention infringes the corresponding patent.  Infringement may be established either literally or under the doctrine of equivalents, whereby an accused instrumentality infringes the patent claim at issue if it performs substantially the same function in substantially the same way to achieve the same result, or is insubstantially different from the patented invention.  This presentation will explore recent case law on the doctrine of equivalents, which remains a viable legal theory for patent owners to utilize in proving infringement.
