Obviousness-type double patenting (“ODP”) is a judicially-created doctrine intended to prevent patent owners from unjustly extending the term of a patent beyond the period provided by statute. Two recent decisions by the U.S. Court of Appeals for the Federal Circuit, Novartis AG v. Ezra Ventures LLC and Novartis Pharmaceuticals Corp. v. Breckenridge Pharmaceutical, addressed the interplay between ODP and a patent term extension granted pursuant to 25 U.S.C. § 156. This presentation will examine the Novartis decisions and explore the lessons we can learn from them, including what qualifies as an ODP reference, when a terminal disclosure should be considered, and what patent prosecution strategies can be used to minimize ODP concerns.
