More and more states are moving towards a per se theory of criminal liability for driving under the influence of drugs. Colorado is the latest in this trend. The trend is to either establish stated Limit of Quantification values or 'any amount' statutes in the prosecution of these offenses. This presentation examines the root questions of these efforts which are 'Do these stated levels relate to science?' and 'Do these levels as applied and proposed relate to likely pharmacodynamic effects in humans?' The sciences of pharmacokinetics and pharmacodynamics as related to an analytical result determined at a point in time will be examined to answer these questions.
