Many nascent ventures and new projects begin with a patent application.  But applying for patent protection without understanding the IP landscape is not always the most productive use of resources.  Understanding the IP landscape in which you innovate generally improves the quality of your patent applications and provides a roadmap for innovation that allows you to foresee future developments.  This presentation will address issues that frequently arise in the course of conducting an IP landscape analysis.  The presentation will focus on recent case law from the U.S. Supreme Court and the Court of Appeals for the Federal Circuit that affects any FTO and infringement analysis, including inducement and contributory infringement, divided infringement, and willful infringement.
