<br/>With marijuana legal for medical or recreational use in many states, workplace drug testing programs for marijuana have come under increased scrutiny. Should a positive test for marijuana, which can show use within the prior 30 days or even longer, be cause for dismissal? Numerous studies have shown that neither urinalysis no blood tests are effective in determining current intoxication levels for marijuana; other studies have indicated there is no significant correlation between marijuana use and workplace accidents if the use was longer than four hours before the worker’s shift. As marijuana laws continue to be reformed, it is logical to consider the number of individuals who legally use marijuana for recreational and/or medical use by adopting workplace drug testing policies that account for periodic use outside the workplace. This presentation will consider options for sensible workplace drug testing policies to address this concern.
