Many important inventions stem from the development of new combinations of known compounds and materials, rather than from the discovery of a new molecule per se. Copolymers, glasses, ceramics, alloys, pharmaceutical and personal care formulations and cleaning formulations, are among the myriad examples of such new combinations. When crafting patent applications directed to chemical and material compositions, properly defining and supporting the invention is critical to obtaining strong patents both in the U.S. and abroad. Careful consideration at the drafting stage can provide desirable claim coverage and flexibility during prosecution and enforcement. We will review case law old and new relevant to combinations of known compounds and materials, and provide some strategies and best practices for disclosing and claiming such inventions.
