Consumer protection from contamination by chemicals is one of the most actual questions in Europe. This has led to the implementation of new national regulations for Food Contact Material (FCM). Consumer protection from contaminations by packaged foods is the base of the framework regulation for materials and articles intended for food contact. A complex European legislation system for plastics as Food Contact materials as well a Guide has been created by the commission. The European Industry request that EU harmonize of rules for all type of Food Contact materials rather than having to meet the national legislations for the same FCM. However, as harmonization processes take such long time different national legislations have been created by different EU member’s country. Such examples of different new national ordinance regarding printing inks and their effect on the trade will be discussed. The different testing procedures to fulfil the different legislation for the same material on the EU market can be a controversy between countries. Import to the EU market will also influence these national regulations. The influence of national regulations on the principle of Mutual Recognition in the European Union will be addressed. This results in an unbalance between benefits to health and safety and drawbacks in terms of impact on the free movement of goods, including the negative impact on economy as well impact on the whole value chain which I the end the consumer is going to pay for
