All too often, many valuable chemical and pharmaceutical patents get invalidated, interpreted very narrowly, or found not infringed by a competitor's product or process. This leads to a significant loss of revenue and market share for the companies that own these patents. Court decisions have consistently pointed to the need for drafting patent applications very carefully. This talk will review recent Federal Circuit Court decisions on patents and provide insights to scientists on how to write and review patent applications such that the patents that are granted from these applications would be successful in a court of law.
