Whether subject matter is eligible for patent protection can seem like a simple question, yet there is enough criticism and confusion surrounding the current state of the law to engender a draft bill proposing revised language to 35 U.S.C. 101. This presentation will provide a brief overview of the proposed legislation and will then dive into how inventors can use the USPTO's Subject Matter Eligibility Guidance to guide what they may or may not be able to patent.
